Official Rules

Enter The LuckySurf Sweepstakes sponsored by Mediastay, North America, Inc., and you may win the Grand Prize - $1,000,000* (U.S.) -- or additional big cash prizes and lots of other awards and gift certificates as described on the "Prize & Award" page. Prizes are not assignable or transferable. No contestant is eligible to win more than one Grand Prize. The promotion will run from 12:00:01 a.m. Pacific Time April 1, 2010 through 12:00:00 am Pacific Time September 30, 2011 (the "Promotion Period").

The Official Rules may be modified between Promotion Periods to take into account changes in the game and are valid for the Promotion Period only.

1. Eligibility

This Sweepstakes is limited to residents of the United States* who at the time of entry have reached the age of majority of the jurisdiction in which they reside and have entered valid and verifiable information upon registration, including name and postal address.

Employees, agents, successors, and assignees of Sponsor (Mediastay, North America, Inc.), its advertising agencies, SCA Promotions and other promotional companies involved in this Promotion, as well as family and household members of same, are ineligible to participate in the Promotion and will be ineligible for any prize covered in these Official Rules. Entrants acknowledge that Sponsor is not liable for reimbursement of any prize otherwise payable to Sweepstakes entrants who are in violation of this provision. Residents of jurisdictions where this Sweepstakes is prohibited by law or subject to registration or other procedures with which LuckySurf.com may not have complied are ineligible for any prize covered herein.

* Residents of France or the United Kingdom who wish to participate in the Sweepstakes will be automatically re-routed to their country appropriate version of the LuckySurf.com site. Those who attempt to bypass the re-routing by entering a country other than their country of residence on their registration form, will not be eligible to claim their prize, should they win.

2. Enter Online

Enter online beginning 12:00:01 a.m. Pacific Time [San Francisco, CA], April 1, 2010 through 12:00:00 a.m. Pacific Time [San Francisco, CA], September 30, 2011(the "Promotion Period"). Each daily "Game Session" begins at 12:00:01 a.m. Pacific Time and ends at 12:00:00 a.m. Pacific Time the following day. A player must complete a registration form and enter all required information. Any invalid or incorrect information will constitute cause for disqualification and player will be ineligible to claim a prize. LuckySurf.com can randomly reward players with the possibility to submit multiple entries per Game Session; all entries submitted through these rewards are valid for the current drawing. If a player is not rewarded with additional entries and the additional entries are submitted in good faith, only the first entry received will be eligible; the additional entries will be voided and disregarded. Access the LuckySurf.com web site at http://www.luckysurf.com and follow the instructions to submit an Official Sweepstakes Entry Form by selecting six (6) numbers between one (1) and forty-nine (49) (with no duplicates) and click on one of the surrounding advertising banners. All six (6) numbers selected are "entered" as one "entry" into the daily drawing with the "click" on the advertising banner. All entries become the property of the Sponsor and will not be acknowledged or returned. Incomplete entries are void. Registration or entries which are completed or entered by other than human means or otherwise not in compliance with these Official Rules will be disqualified and the entrant ineligible for future participation.

3. Prizes

• Grand Prize #1. Each entry that contains the first five numbers (in any order) and the exact sixth number to the six (6) numbers on the 10^th grid of play, will win $1,000,000 (U.S.).  The $1,000,000 (U.S.) prize is payable $25,000 (U.S.) per year over 40 years, pending verification of entrant's eligibility.  If more than one (1) entry submitted matches all of the winning numbers selected, the Grand Prize will be equally shared among the correct entries.

• Grand Prize #2.  $15,000 (U.S.) will be awarded to each entrant that matches (6) winning numbers (in any order) without matching the bonus ball on the 10^th grid. If more than one (1) entry submitted matches all of the winning numbers selected, the Grand Prize will be equally shared among the correct entries.

• First Prize.  $5,000 (U.S.) will be awarded to each entrant that matches in any order six (6) numbers selected on grids 1 through 9.

• Second Prize: A Twenty ($20) USD gift card will be awarded to each entrant that matches five (5) of six (6) numbers in any order on the 10^th grid.

• Third Prize. A Fifteen ($15) USD gift card will be awarded to each entrant that matches five (5) of six (6) numbers in any order on grids 1 through 9.

• Fourth Prize. 150 points will be awarded to each entry that identically matches four (4) of the six (6) numbers selected.

• Fifth Prize. 40 points will be awarded to each entry that identically matches three (3) of the six (6) numbers selected.  

• Sixth Prize. 25 points will be awarded to each entry that identically matches two (2) of the six (6) numbers selected.

• Seventh Prize. 10 points will be awarded to each entry that identically matches one (1) of the six (6) numbers selected.

Odds of winning: Grand Prize -- $1,000,000 (U.S.) prize: 1: 83,902,896; $15,000 (U.S.) prize: 1: 13,983,816; First Prize -- 1: 13,983,816; Second Prize - 1:54:201; Third Prize -- 1:54,201; Fourth Prize -- 1:1,032; Fifth Prize -- 1:57; Sixth Prize -- 1:8; Seventh Prize - 1:2.

4. Selection of Winners

Each day during the Promotion Period six (6) winning numbers between one (1) and forty-nine (49) will be selected at approximately 12:00 a.m. Pacific Time [San Francisco, CA time]. These numbers will be matched against all eligible entries received between 12:00:01 a.m. Pacific Time the previous day and 12:00:00 a.m. Pacific Time that day ("Game Session"). Winners will be selected daily (except certain designated legal holidays) at approximately 12:00 a.m. Pacific Time by matching the first six (6) numbers randomly selected by a secure automated drawing process and verified against all eligible entries.

• Multiple winners for Grand Prize 1 and Grand Prize 2: No contestant is eligible to win more than one Grand Prize. If more than 1 winner occurs for  Grand Prize 1 or 2, it will be equally shared among the correct entries.

• Simultaneous winners for Grand Prize 1 and Grand Prize 2: For one draw, if you select 5 winning numbers and the bonus ball on the 6th number on any grid including grid 10, you win the higher prize, Grand Prize 1. For one draw, if you select 6 winning numbers on any grids including grid 10, you win the higher prize, Grand Prize 2.

5. Announcement of Winners

Winning numbers will be posted on the LuckySurf.com web site (www.luckysurf.com). Potential winners will be notified by mail or e-mail within two (2) weeks of each drawing. If a potential winner cannot be reached after ten (10) days from the first notification attempt, is found to be ineligible, declines to accept a prize, or in the event that a prize or prize notification is returned as undeliverable, the prize will be forfeited. If, in the case of a yearly payment, the payment is returned as undeliverable, the rest of the yearly payments will be forfeited. Gift certificates will be issued to winners directly via e-mail. Potential winners may be required to furnish picture proof of identification, which may include a driver's license, passport, voting card or similar government issued identification. Such proof must match the information provided to the sponsor on the registration form of the sweepstakes. Each potential winner of $1,000 (U.S.) or more will be required to sign an affidavit of eligibility, release of liability and publicity, including, but not limited to, the use of winner's name, hometown and photograph without additional compensation (where lawful) which must be signed, notarized and returned to Sponsor within fourteen (14) days of receipt, or prize will be forfeited and potential winner will be disqualified. Each winner's name, city and country of residence may be shown on the LuckySurf.com web site within thirty (30) days after each day's drawing. A list of winners may also be obtained by sending a self-addressed, stamped envelope to: LuckySurf.com WINNERS' LIST, 350 Sansome St, Suite 740, San Francisco, CA 94104. Winners' lists showing Grand and First Place prize winners will be updated periodically and will show each winner's name, city and state, the value of the prize won, and the dates upon which the prize was won and delivered to all such winners during the previous ninety (90) days. Prize winners should receive payment within ninety (90) days of verification of their eligibility and identity. Names and likeness of winner(s) may be used by Sponsor (Mediastay, North America, Inc.) and Sponsor's designee(s) for promotional purposes without further compensation to Sponsor or the winner(s).

6. Points

A member can never redeem points for money. Points have no cash value.

A member can redeem points for gifts a maximum of 3 times per month, per member.

If a member does not play 1 grid on luckysurf.com during the following dates: (*April 1, 2010 through June 30, 2010  *October 1, 2010 through December 31, 2010  *April 1, 2011 through June 30, 2011) the Sponsor reserves the right to revoke all points earned.

7. LuckySurf Premium

Luckysurf Premium is optional and offers better playability. Luckysurf Premium requires payment of a fee/fees. You must have an Account and pay the subscription or other fees to access this service.

Trial Period

Luckysurf Premium offers a 3-day Trial Period where users who choose to join Luckysurf Premium can try it out for three (3) days. You will be charged initially but if you cancel your premium subscription during the trial period,
you are still entitled to the premium functionalities until the end of that
period. You will also get refunded if you cancel within the three days. The trial period is limited to one per person per year.

Subscription

Users have two (2) options of payment when subscribing: $2.99 per month or $26 per year (a savings of almost $10 if you choose the annual subscription). Users will be charged $2.99 per month for the thirty (30) day subscription and is automatically renewed at $2.99 each month until canceled by the member. Users may terminate their subscription at any time by accessing their account in Moneybookers too (please see 7.0). https://www.moneybookers.com/app/help.pl?s=terms. Luckysurf reserves the right to not refund any fees that may have accrued on your Account before cancellation of your subscription and there will be no proration of fees for any subscription. The user is solely responsible for the purchase by credit card and certifies to be the bearer of the card to be used. Minors are prohibited to subscribe on Luckysurf Premium services.

If you'd like to unsubscribe from Luckysurf Premium you can do so by following the steps below. Be careful though because if you unsubscribe on Luckysurf premium you'll never be able to subscribe again on our premium services. This applies to the trial offer as well.

Please Note: If you decide to opt out during the 3-day Trial Period, you will not be able to play the free game until the trial period is over.

Restrictions on Luckysurf Premium

Members receiving a trial membership will not have access to the Luckysurf Premium Shop as their subscription is not confirmed either by action on their part on the site before the end of the trial period or by automatic validation of their subscription after the trial period.

Taking into account the payment:

Transactions made by the member are made via the payment platform Moneybookers which ensures reliability and security https://www.moneybookers.com/app/help.pl?s=terms. All transactions signed by the member by agreeing on Moneybookers are irrevocable.

8. Privacy Notice

Any information entrants provide to the Sponsor will be used to communicate with entrant in relation to this Sweepstakes. Sponsor may also share this information with advertisers to contact entrants at a future date about new product and services Sponsor believes entrants will find of interest. 9. Legal

• No purchase or online access fee necessary. Some Internet service providers are free.

• Void wherever prohibited or restricted by law.

• Mediastay, North America, Inc. is being designated as "the Sponsor". The "Sweepstakes" is a 6 of 49-lottery type promotion.

• By entering the Sweepstakes, entrants agree to abide by all terms of the Official Rules and the decisions of the Sponsor, made in its sole discretion, which shall be final. Sponsor is not responsible for incorrect, or inaccurate transcription of entry information, for any human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, theft or destruction or unauthorized access to, or alteration of, entries, for line failures or other failures of any telephone network, server, providers, computer equipment, software or any combination thereof, for inability to access any web site or online service or any other error or malfunction, or for late, lost, illegible, misdirected or incomplete entries which may limit a player's ability to participate. Sponsor is not responsible for any injury or damage to participants or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes. Sponsor is not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed software transmissions or any mistake in the printing of these rules or failure to make e-mail notifications, if any, to players. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE LEGITIMATE OPERATION OF THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, LUCKYSURF.COM RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. • Incorrect or inaccurate information supplied on the registration form will cause subsequent entries to be void and ineligible for a prize.

• Entry materials that have been tampered with or altered are void. No copies, facsimiles or reproductions of online entry form will be accepted. Mechanically duplicated, mass machine printed entries, or entries not otherwise in compliance with the Official Rules will be disqualified. Proof of e-mailing does not constitute proof of delivery.

• If by reason of a printing or other error, more prizes are claimed than the number set forth in these official rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded.

• If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Mediastay, North America, Inc. which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Mediastay, North America, Inc. reserves the right at its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes.

• If a dispute arises regarding who submitted an online entry, the entry will be deemed submitted by the person in whose name the entry was made.

• No substitution or transfer of prizes permitted by winners. Taxes, if any, are the winners' responsibility. If the prize is not a cash prize, Sponsor may refuse delivery of prize until such time as the winner provides Sponsor with the monies necessary to meet applicable tax withholding requirements. The Grand prize is paid only to the winner during his/her lifetime and cannot be assigned, transferred or inherited by heirs or any other person.

• Winners, by acceptance of a prize, agree to release the Sponsor, its parent, subsidiary and affiliated businesses and each of their officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives and any other person or entity associated with this Sweepstakes from any and all liability claims or actions of any kind whatsoever for injuries, damage or losses to persons and property which may be sustained in connection with the receipt, enjoyment, ownership or use of the prize. The Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of any prize awarded.

• The laws of the United States govern this promotion. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Delaware, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Delaware or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of Delaware.

• Each entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) if the parties are unable to resolve their dispute amicably, it shall be resolved; (c) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
